On November 13, 2024, the European Commission issued Regulation (EU) 2024/2856 amending Annex I to Regulation (EC) No 1334/2008 of the European Parliament and of the Council on the deletion of the flavoring substance 1,2-Benzenedithiol (FL No. 04.029) from the list of permitted food additives. The main elements are as follows:
(1) Foods to which 1,2-Benzenedithiol has been added and which were legally placed on the market before the entry into force of the Regulation may continue to be marketed until their minimum shelf life or shelf-life;
(2) Foodstuffs imported into the EU are spiked with 1,2-Benzenedithiol if the importer of such foodstuffs can prove that they were shipped from the third country concerned and were in transit to the EU before the entry into force of the Regulation;
(3) Paragraphs 1 and 2 do not apply to 1,2-Benzenedithiol and preparations containing the substance (meaning flavouring agents or mixtures of one or more flavouring agents with other food ingredients, such as food additives, enzymes or carriers, to facilitate their storage, marketing, standardization, dilution or dissolution) not intended for consumption as benzene-like substances;
(4) The Regulation enters into force on the twentieth day after its publication in the Official Journal of the European Union.
