EU Court Rules: No Duplicate Nutrition Labeling Required for Foods for Special Medical Purposes
On December 11, 2025, the Court of Justice of the European Union (CJEU) ruled that nutrition information must not be repeated on labels of Foods for Special Medical Purposes (FSMPs). Article 5(2)(g) and Article 6(2) of Commission Delegated Regulation (EU) 2016/128 of September 25, 2015, should be interpreted as follows: energy values and nutrient contents per portion or per consumption unit displayed on the front of FSMP packaging—if the mandatory nutrition declaration on the back of the packaging already includes the same elements per 100 grams or 100 milliliters—do not constitute "product characteristics" as referred to in Article 5(2)(g) of the Regulation. Instead, such repetition falls under the duplication of mandatory nutrition information prohibited by Article 6(2) of the Regulation.
