The SAMR Issued the "Q&A on Health Food Fraud and False Promotion Rectification"

 In order to promote food health food fraud and false promotion and rectification work, the SAMR issued the "Q&A on food health food fraud and false promotion rectification" to provide relevant laws, regulations and standards reference.  

The Q&A provides information that cover from basic common sense, production and operation license, label identification, special food, imported food, false advertisement promotion, fraudulent sales and in the aspects of advertising review and supervision, illegal addition and testing, etc.. The Q&A systematically sorts out the relevant laws, regulations and standards, and adopt “the question and answer” method to facilitate the reference of the local regulatory authorities in the rectification work.

28. What are the requirements for labels, instructions, etc. for health foods?
 The labels and instructions for health foods shall not be related to disease prevention and treatment functions. The contents shall be true and consistent with the contents of registration or filing, indicating the appropriate targeting population, unsuitable population, functional ingredients or symbolic ingredients and their contents, and stating This product is not a substitute for drugs." The function and composition of the health food should be consistent with the label and instructions.

 

29.What are the requirements for labels and instructions for FSMP?
According to the provisions of article 33- 38 of the "Administrative Measures for Registration of FSMP", the label of FSMP shall conform to the provisions of the "National Food Safety Standard for pre-packaged food label " (GB 7718-2011). The contents of the label and instruction manual of FSMP shall be consistent with that of the registration certificate, and the registration number shall be indicated. If the label has covered all the contents of the specification, the specification may not be attached. Labels and instructions shall be true and accurate, clear and durable, and easy to read. It shall not contain false contents and shall not involve the functions of disease prevention and treatment. The manufacturer shall be responsible for the label. The following contents shall be marked prominently in the label and instruction: 

(1) please use it under the guidance of a doctor or a clinical dietitian;

(2) not applicable to non-target population;

(3) this product is prohibited for parenteral nutrition support and intravenous injection.

 

32.What are the requirements for label of imported food?

According to the provisions of article 97 of the Food Safety Law, imported pre-packaged food and food additives shall be labeled in Chinese and shall also have a Chinese instruction. Labels and instructions shall comply with the  Food Safety Law, other laws and regulations of China and the requirements of the GBs, and shall state the origin of the food and the name, address and contact information of the agent within China.
