Case Study | Product name “crispy pineapple cake” meets food safety standard or not

Case Study | Product name “crispy pineapple cake” meets food safety standard or not

Wan purchased Jinzun Crispy Pineapple Cake (Macao-style snack biscuits). Wan found out there is no pineapple in the ingredient list and considered that the label did not indicate the true nature of the food, violating the Article 3.4 and Article 4.1.2.1 if GB 7718-2011 National Food Safety standard General Standard for the Labeling of Prepackaged Foods.

However, the court ruled that the product was marked with "pineapple flavor" and other ingredients, the name of the food did not constitute a misleading to consumers. Therefore, the compensation claim was not supported.
