US intends to develop third-party disclosure and record-keeping requirements for reportable foods

On May 19, 2023, according to the Federal Register, the U.S. Food and Drug Administration (FDA) issued Notice 2023-10880, which proposes to establish third-party disclosure and record-keeping requirements for reportable foods. FDA provides a reliable mechanism to track the prevention of adulteration in food products, designed to enable FDA to quickly identify and track food products (other than infant formula) and ensure that such products are quickly and effectively recalled from the market; The responsible party is required to notify the prior source and/or direct subsequent recipient of the notifiable food containing the following:

 

(1) The date on which the food was identified as a notifiable food;

 

(2) Description of the quantity and quantity of food articles;

 

(3) the degree and nature of adulteration;

 

(4) The results of the investigation into the cause of the adulteration (if known) may have originated with the responsible party;

 

(5) the disposition of food (if known);

 

(6) Product information normally found on packaging, including the product code, expiration date and the name of the identified manufacturer, packer or distributor;

 

(7) Contact information of the responsible party;

 

(8) Contact information of the parties, if applicable; Food related records should be reported for at least 2 years.

 

The notice will be published in the Federal Register on May 22, 2023. There is a 60-day comment period.
