Case review:
On September 30, 2018, a customer claimed that the food label of the product purchased from XXX Supermarket did not meet relevant requirements. The product was labeled as Lemon prune (Preserved fruits category) and the ingredients of the product are "plum, white sugar, edible salt..”
The illegal fact:
Article 4.1.2.1 of GB 7718-2011 National Food Safety Standard General Standard for the Labelling of Prepackaged Foods: A distinctive name that reflects the true attributes of the food should be clearly marked in a prominent position on the food label.
Analysis:
The product name in the case is labelled as Lemon prune (Preserved fruits category), and the ingredients are "plum, white sugar, edible salt..." with NO lemon addition. Prune belongs to the Armeniaca Mill of the Rosaceae family, however the plum belongs to the Prunus genus of the Rosaceae family. They are not the same type of fruit. So the product should not be named as lemon prune, it should be called plum (Preserved fruits category). Therefore, the product name does not reflect the true nature of the food, which is against the requirement of GB7718.
Penalty result:
The payment was refunded, and a compensation (RMB 1000) was paid.
