Case Study|Food Product False Promotion

Case Introduction
A trade company in Tianjin produced a self-editing content to create an advertising banner. The promotion content includes “selenium-enriched malt powder, the same product contains the highest selenium, scientific safety, anti-cancer, cancer-preventing, anti-aging, cell-repair nutrients”, “Noli concentrate” taken from the Queen of Fruits, Noli fruit, pure natural, non-polluting, zero additive added; rich in 227 kinds of nutrients, anti-inflammatory and antibacterial, clearing the intestines, repairing cells, preventing insomnia, enhancing immunity, etc. After investigation, "Selenium-enriched malt powder" and "Noli concentrate" are common foods, and the above-mentioned contents claimed by the parties are false advertising.

Legal Basis and Punishment

The above-mentioned acts of the parties violated the provisions of the first paragraph of Article 8 of the Anti-Unfair Competition Law. According to the provisions of the first paragraph of Article 20 of the Anti-Unfair Competition Law, the parties were ordered to stop the illegal acts and imposed a fine of RMB 200,000 yuan.
