The Organic Virgin Olive Oil purchased by Xu was labelled with an organic product certification mark on the outer package. Upon inquiry, the organic certificate of the product has already been revoked.

The court concluded that using organic product certification mark when the organic product certificate is invalid was violating the provisions of GB 7718-2011. However, no evidence showed quality problems of the abovementioned product, except for the label flaw. Therefore, the product was not the food that does not meet food safety standard as stipulated in Food Safety Law.   

The court sentenced that the company shall refund Xu’s payment and rejected Xu’s ten time’s compensation claim.
