Shen purchased a food without the labelled production date on package, but the best before date was marked on the bottom of the product. 

The court of second instance considered that the product involved was not marked with production date, but the best before date was marked, which would not affect food safety and would not be misleading to consumers. Therefore, the court of second instance rejected the original ruling of the court of first instance, which is a rejection of Shen’ claim of ten times’ compensation.
