Case study | Hipp was sentenced to "modify advertising language" for over-promoting milk powder
According to German media reports, Hipp’s over-promotion of its milk powder is comprehensive nutrition and advertising slogans suggesting it is more suitable for children. This caused dissatisfaction with the German Federal Consumers Association (VZBV). It believed that Hipp’s Combiotik children’s milk powder was false promotion and sued it to the Munich District Court.
In this regard, the court made a ruling after hearing that Hipp’s children’s milk powder was false promotion and should not be used with excessive advertising language. The Munich District Court ordered Hipp to modify its advertising language.
It is understood that the two products of Hipp involved in the lawsuit are Hipp Kindermilch Combiotik ab 1+ Jahr and Hipp Kindermilch Combiotik ab 2+ Jahr. For these two milk powders, German Hipp’s online slogan is: "Your child needs vitamin D more than adults. Hipp Kindermilch Combiotik guarantees that children can get more than three parts of calcium and more than seven parts of vitamin D."
The German Federal Consumers Association believes that infant food manufacturers should be more responsible. Parents should not feel that they have to buy a special food to feed their children, especially children over one year old. Children do not need special nutritious food. Hipp emphasizes that their milk powder contains more vitamins and calcium to encourage parents to buy it. This can be regarded as false advertising and excessive publicity.
