FDA announces changes to the export listing procedures for dairy products and infant formula companies that export products to China
Foodmate News: On July 28, 2020, FDA announced changes to the export listing procedures for dairy products and infant formula companies that export products to China.
In the "Economic and Trade Agreement between the U.S. Government and the Government of the People’s Republic of China" ("Economic and Trade Agreement") on January 15, 2020, China agreed to recognize that the US dairy product safety system provides at least the same level as the Chinese dairy product safety system.
According to the "Economic and Trade Agreement", companies seeking to be listed as eligible to export dairy products and infant formula to China should no longer provide it to the FDA, and the FDA will no longer provide confirmation that third-party auditors found that the company meets relevant Chinese standards, laws and regulations to China. On June 24, the United States Department of Agriculture's Agricultural Marketing Service took action in accordance with “Economic and Trade Agreement” and announced that it would cancel the factory audit of dairy products and infant formula companies seeking to export to China from July 1, 2020.
The FDA reminds companies that intend to export dairy products and infant formula to China that they will only be included in the export list if the company basically complies with applicable FDA regulations. Companies can apply for inclusion in these lists through the FDA's Export List Module (ELM).
This process applies to all ELM applications for these export lists received on or after July 1, 2020.
