Interpretation of the Supreme People's Court on Several Issues Concerning the Application of Law in the Trial of Civil Disputes on Food Safety (1) was adopted at the 1813th meeting of the Judicial Committee of the Supreme People's Court on October 19, 2020, and is hereby promulgated. This Interpretation shall come into force on January 1, 2021.
The interpretation stipulates that consumers claim compensation for food sold by e-commerce platforms and public transportation carriers that do not meet food safety standards. The court should support it. If the food does not meet the food safety standards and the producer or operator argues that it has not caused personal injury to the consumer, the court shall not support it.
The imported food does not meet China’s national food safety standards or the standards that have been temporarily applied. Consumers claim liability for compensation. Sellers, importers and other operators only makes a defense against liability only on the grounds that the imported food meets the food safety standards of exporting country or has passed the inspection and quarantine of China's entry-exit inspection and quarantine agency, the court shall not support it.
If the judicial interpretation previously issued by the Supreme People's Court is inconsistent with this interpretation, this interpretation shall prevail.
