Australia begins to implement new agricultural export legislation


On March 31, 2021, Australia notified the WTO of the draft directive (G/SPS/N/AUS/433/Add.8), informing that its new agricultural export legislation has begun to be implemented. The new legislation has been streamlined and merged more than 20 bills and 40 authorized legislation involved in export-related requirements, including:

• The Export Control Act 2020, which sets out the overall legal framework for the control of Australian export commodities, including food and agricultural products.

• The Export Control Rules 2021 is a legislative instrument that stipulates the operational requirements that must be met when exporting certain commodities (such as meat) from Australia. This rule must be read in conjunction with the aforementioned export control law.

The new legislation will come into effect at 3 a.m. Eastern Daylight Time on March 28, 2021. The website of the Ministry of Agriculture, Water and Environment will publish the latest information on the new legislation that day. All trading partners can check this information. Any questions about the new legislation can be consulted with the Australian government through the Australian SPS notification agency.
