Ukraine plans to formulate regulations on the quality and safety of infant food

 On 17 May 2022, the Ministry of Health of Ukraine issued draft regulations on the quality and safety of infant food and proposed to repeal Decree No. 696 of 2013.  The main contents of the draft include:

 (1) The regulation applies to infant formula food and elder infant formula food, grain-based infant food, and other supplementary food for infants, but does not apply to infant formula food/water for special medical purposes. The relevant food that does not meet the requirements of the regulation shall not be put into the market;

 (2) Maximum residue limits of drugs in the cultivation and breeding process of primary raw materials used in the production of relevant food are stipulated, and the limits of pollutants should meet the requirements of Ukraine's "Maximum Allowable Limits of Certain Pollutants in Food" standard;

 (3) Infant formula food is the only allowed food for baby use in market, it should be made from protein source specified in Annex 1 and Annex 2, and other ingredients assessed suitable for the baby. Elder infant formula should be made from protein source specified in the Annex 2 and Annex 3, and other ingredients assessed suitable for the baby. Infant formula food and elder infant formula food shall be prepared in a manner that requires no preparation other than water or other liquids suitable for dilution, with MRL of 0.01mg/kg of drug residue, and the use of drugs in Annex 5 shall be prohibited, and the use of nutritional fortifiers shall meet the requirements in Annex 6;

 (4) The basic ingredients of grain-based infant food and other supplementary infant food should meet the requirements of Annex 7, and other supplementary ingredients should meet the requirements of Annex 8. Grain-based infant food can only add nutrients in Annex 9, with drug MRL of 0.01mg/kg, and drugs in Annex 95 are prohibited;

 (5) Labels and advertisements of infant food should comply with the requirements of Ukrainian food labeling and advertising regulations, while labels of elder infant formula food should indicate nutrient reference values of vitamins and minerals that may be contained, and nutritional value and health benefit claims are prohibited. Lactose labels should comply with the requirements of Annex 11.  The labels of grain-based baby food should indicate the permissible age of children (no less than 4 months old), gluten content, energy value, main nutrient content, vitamin and mineral content, etc.

 (6) The regulation will take effect three months after its official promulgation, and there will be a transitional period of three years. The food that meets the requirements of previous regulations in force, but does not meet the requirements of this new regulation, can be imported to Ukraine within three years after this regulation takes effect and can be sold and used until the expiration of the shelf life.
