On 29 June 2022, the European Union (EU) issued Directive 2022/1023 authorizing the use of oat lecithin in cocoa and chocolate as follows:
(1) Authorising the use of oat lecithin as an emulsifier in the food category "Cocoa and chocolate products covered by Directive 2000/36/EC" is appropriate, up to a maximum of 20,000 mg/kg;
(2) appendix II of regulation (EC) no 1333/2008 is amended in accordance with appendix I of this regulation by adding food additive item E322, the maximum amount of oat lecithin used is 20000mg/kg;
(3) Appendix to Regulation (EU) No231/2012 is amended in accordance with Appendix II of this Regulation by adding E322a oat lecithin, a graded oat oil rich in polar lipids (mainly semi-milk fat), which is derived from food-grade oat kernel. Its characters includes: choline no more than 2g/100g, phosphorus no less than 0.5%, gluten no more than 20mg/kg, etc.
The directive shall enter into force 20 days after its promulgation.
