EU Revised Regulations for Entry Certificates of Specific Animal-Origin Foods

On 20 November 2023, the Official Journal of the European Union published Implementing Regulation (EU) 2023/2744, amending Regulation (EU) 2020/2235 on official certificates for the entry into the European Union of products of animal origin, which will enter into force 20 days after the publication and will apply directly to all Member States. Major revisions include:

 

(1) Amend point b (i) of Article 1 (3) to read "Products of animal origin and composite products requiring such certificates in accordance with Article 21 of the Commission's Authorisation Regulation (EU) 2022/2292";

 

(2) Paragraphs 4 and 5 of Article 2 are amended respectively to read: "' insect 'means an insect referred to in Article 2, paragraph 27, of authorizing Regulation (EU) 2022/2292" and "' refrigerated ship 'means a refrigerated ship referred to in Article 2, paragraph 43, of authorizing Regulation (EU) 2022/2292 ";

 

(3) Article 14, paragraph 3, is amended to read "an official certificate provided by authorisation Regulation (EU) 2022/2292 for bivalve and mollusc aquatic products for human consumption, signed by the ship's captain and entering the European Union directly from a refrigerated, frozen or processed ship flying the flag of a third country, as referred to in point b (i) of Article 1, paragraph 3, Shall correspond to the FISH/MOL-CAP certificate template contained in Annex III, Chapter 30 ";

 

(4) Point b of clause 16 is amended to read "The milK-RMP /NT certificate template set out in Chapter 34 of Annex III applies to dairy products for human consumption made from raw MILK or raw dairy products or both which do not require specific risk reduction treatment";

 

(5) Article 33 is amended to read "Model private certification of shelf-stable composite products containing processed products of animal origin other than processed meat by the operator for shelf-stable composite products for entry into the European Union issued by the operator in accordance with Article 22 of the Authorisation Regulation (EU) 2022/2292, in accordance with point (f) of Article 1 (3), Shall correspond to the template specified in Annex V ";

 

(6) During the transition period until 15 September 2024, certificates issued under Regulation (EU) 2020/2235 prior to the amendment of this Regulation will remain eligible for customs clearance in the EU, provided that the relevant certificate was issued no later than 15 June 2024.
