port" transaction dispute. The plaintiff purchased a brand of pure cocoa powder through a cross-border e-commerce platform, and the outer packaging had no Chinese label. The court held that although there was no paper Chinese label on the goods involved in the case, the goods met the food safety standards of China after testing, and the behavior of replacing Chinese labels with electro
nic labels did not co
nstitute food label defects, so all the plaintiff's claims were rejected.
杭州互联网法院跨境贸易法庭受理一起“跨境电子商务零售进口”交易纠纷案件。原告通过跨境电商平台购买某品牌纯可可粉,外包装无中文标签。法院认为,案涉商品实物虽无纸质中文标签,但商品经检测符合我国食品安全标准,其通过电子标签替代中文标签的行为亦不构成食品标签瑕疵,遂驳回原告全部诉讼请求。
