Q&A | New Regulations on Import & Export Food I
Since the General Administration of Customs of China issued the “Administrative Measures on import and Export Food Safety of the People's Republic of China” and the "Administrative Regulations on the Registration of Overseas Manufacturers of imported Food of the People's Republic of China" on April 13, 2021, many food manufacturers are very concerned about them. On April 26, Foodmate held a webinar and invited several experts to discuss these 2 regulations. In addition, we collected questions from attendees and asked experts to answer these questions. Today, Foodmate will share some representative questions for your reference.
1. Should pre-packaged seaweed products be labeled in accordance with the requirements of Article 30 for imported aquatic products?
Answer: Seaweed is a processed product of algae vegetables and does not need to be marked in accordance with this regulation.
2. In Article 7 of the registration entity requirements, is it a foreign supplier or a manufacturer that needs to be registered?
Answer: The registration entity is an overseas food manufacturer.
3. Do food additives and condiments need to be registered?
Answer: According to the “Administrative Regulations on the Registration of Overseas Manufacturers of imported Food of the People's Republic of China”, the food additives manufacturers and the production, processing and storage enterprises of food-related products do not register. Article 7 stipulates condiment manufacturers should be recommended to the General Administration of Customs for registration by the competent authority of the country (region) where they are located.
4. According to Article 30, is there no need for instructions for other types of food except for meat, aquatic products and health products?
Answer: If there should be an instructions according to law, there should also be a Chinese instructions.
5. Before the promulgation of the new regulations, should the registration materials applied by these overseas manufacturers that need to be registered be submitted to the General Administration of Customs or the local customs?
Answer: The enterprises that currently need to register should submit materials to the corresponding supervisory authority of their country, who will uniformly recommend registration to the General Administration of Customs.
