On 20 July 2022, the Government of Canada issued a communique amending the Food and Drug Regulations (SOR/2022-168) and the Supplementary Food Regulations (SOR/2022-169). Among them, the main contents of food and drug regulations are as follows:
(1) Revised definitions of agricultural chemicals and food additives;
(2) Revise the requirements of labels (including supplementary foods). The font height of ingredients list should not be less than 1.4mm, and the warning note should be clearly marked for allergen, sulfite, aspartame, sucralose, acesulfame potassium or neotame. The standard word "include" should be used, and the font height should be greater than 0.2. For example, those containing aspartame should state that "the food contains phenylalanine or aspartame contains phenylalanine";
(3) Revised nutrition labels, include nutrient content claims and functional claims, allowing appropriate nutritional claims for supplementary foods;
(4) The content of modified, transesterified or completely hydrogenated oil in food shall be less than 15% of the total product;
(5) Revised requirements for goat milk, such as goat milk or goat milk powder can not add vitamin D.
The main amendments to the supplementary food regulations are as follows:
(1) To revise the definitions of hydrogenated oils and prepared dishes;
(2) Revised label requirements, the font height of ingredients list shall not be less than 1.4mm, and warning instructions shall be marked significantly for allergen, sulfite, etc., and the font height shall be greater than 0.2mm. For example, for complementary foods containing erythritol, the erythritol content should be indicated;
(3) Revised nutrition labels, include nutrient content claims and functional claims, allowing appropriate nutritional claims for supplementary foods;
(4) Revised the list of supplementary ingredients allowed in supplementary foods, the list of supplementary food categories, warning terms, and the scope of supplementary foods (for example, do no contain food for infants or children, drinks with alcohol content over 0.5%, etc.);
(5) To amend advertisements for supplementary foods. EX. no expression or implied statement of amino acids shall be made without the claim about protein content.
The above amendments are effective from July 20, 2022.
