South Korea modifies food functional labeling or advertising requirements

On October 17, the Ministry of Food and Drug Safety (MFDS) of the Republic of Korea issued Notice No. 2024-62 to revise parts of the functional labeling or advertising requirements for food products. The main contents of this revision are as follows:

 

1. Develop functional raw material requirements for food: functional raw materials added to food need to be proven effective through human application tests; Add in accordance with the required proportion; Manufacturers of functional raw material ingredients are required to obtain HACCP or GMP certification.

 

2. The inspection method indicated on the label of functional ingredients may adopt the specified inspection process and method; The detected value of the functional component content is at least 80% of the labeled value; The content of the functional raw material or ingredient shown on the label must be maintained up to the shelf life, at least 6 months from the date of production or import;

 

3. The labels required for functional labeling of ordinary food include: content of functional ingredients, maximum daily intake, declaration that "this product is not a functional food for health", declaration that the product should not be used for disease prevention or treatment, and declaration that if adverse reactions occur, it is necessary to stop taking and consult experts.
