Brazil seeks comments on a draft regulatory framework, processes and procedures for food formalization

On September 8, 2022, the National Health Surveillance Agency of Brazil issued public consultation No. 1113 and No. 1114 to formulate regulations on the standardized supervision of food and food-related products by the National Health Surveillance System (SNVS) in Brazil. The feedback period ends on December 14, 2022. Among them: 

 

(1) Consultation document 1113 sets out the framework, processes and procedures for the regulation of food products and their packaging under the purview of the SNVS and applies to products supplied and circulated in the Brazil. The main contents are as follows: the preliminary provisions stipulated the scope of application, the content of the regularization procedure, the terms of food, packaging and food raw materials; General requirements for food and packaging standardization, including registration, documentation to prove product compliance with health standards, etc.; Specific requirements for food registration, re-registration, cancellation of registration and changes after registration, including documents and materials provided; Notice and assessment, maintenance, cancellation and change of food production and import;

 

(2) The consultation document No. 1114 stipulated the categories of food that need to be registered or recorded (6 categories of food, such as infant formula and some formula food for special medical purposes, are included in the registration management; 9 categories of products, such as desalinated seawater, food claiming to have health or functional properties, and infant cereal auxiliary food, are included in the filing management), and the documents and technical data requirements to be submitted by the applicant for registration or filing, etc.
