On 23 August 2023, the Ministry of Agriculture and Food Sovereignty of the French Republic published draft Decree 2023/0510/FR on the use of certain names for foods containing vegetable proteins and notified the European Commission in accordance with Regulation (EU) No1535/1169, with a feedback period until 24 November 2023. The main contents include:
(1) The Act applies to foods containing plant proteins and aims to regulate the names of the relevant foods, and does not permit the use for the purpose of description, sale or promotion of the names of unadded plant proteins, animal species and foods of animal origin listed in Annex I (fillet of meat, sirloin, ribs, ham, etc.) except as specified in the unlawful Order;
(2) Foods of animal origin containing a specific proportion of plant protein (such as salami containing no more than 1% of the dry weight of plant protein) and combined foods containing ingredients of animal origin that are added to, but do not replace, the range of combinations may still be named by the name of food of animal origin;
(3) Foods legally produced or sold in other Member States of the European Union or in third countries are exempt from this law, and foods that do not comply with this law are not allowed to be sold in France;
(4) The Decree shall enter into force three months after its official publication, and a transitional period of up to one year may be granted for foods already produced before its entry into force.
