Recently, the U.S. Environmental Protection Agency (EPA) issued a final order terminating all food uses of six chlorpyrifos products made by Drexel and three made by Loveland, but retaining their use in 11 crops in specific states.
- The Drexel products include Drexel Chlorpyrifos 15G (Registration No. 19713-505), Drexel Chlorpyrifos 4E-AG (Registration No. 19713-520), Drexel Chlorpyrifos 15GR (Registration No. 19713-521), Drexel Chlorpyrifos Technical (Reg. No. 19713-573), Drexel Chlorpyrifos 4E-AG2 (Reg. No. 19713-599) and Drexel Lambdafos Insecticide (Reg. No. 19713-671).
- Loveland products include Warhawk (Registration No. 34704-857), Warhawk Clearform (Registration No. 34704-1077), and Match-Up Insecticide (Registration No. 34704-1086).
In addition, EPA canceled three Drexel chlorpyrifos products: the Drexel Chlorpyrifos Concentrate (Registration No. 19713-518), the Drexel CHLOR-PY-REX Chlorpyrifos Insecticide (Registration No. 19713-527), and the Drexel Chlorpyrifos 99% Technical (Reg. No. 19713-575).
Chlorpyrifos is an organophosphate insecticide that was used on a wide variety of food crops, including soybeans, fruit trees, broccoli, cauliflower, and other row crops, as well as for non-food uses.In August 2021, EPA revoked all residue limits for chlorpyrifos, halting its use in all food and animal feed.EPA made this move in response to an April 2021 U.S. Court of Appeals for the 9th Circuit order requiring the agency to issue a final rule addressing chlorpyrifos residue limits within 60 days without public comment or further fact-finding.
On November 2, 2023, the U.S. Court of Appeals for the Eighth Circuit vacated EPA's August 2021 rule vacating all residue limits.On February 5, 2024, EPA published a Federal Register notice to reflect the court's reinstatement of these residue limits. Currently, all chlorpyrifos residue limits from the pre-August 2021 final rule have been reinstated and are in effect.
On July 15, 2024, EPA published a notice of Drexel's and Loveland's request to voluntarily cancel or terminate the registered uses of these products, which was open for public comment until August 14, 2024.1 EPA also published a notice of the request to voluntarily cancel or terminate the registered uses of these products. The agency received one comment on this notice. After considering this comment, the agency ultimately decided to accept Drexel's and Loveland's request to voluntarily cancel or terminate these products. Distribution, sale, or use of existing inventory of these products will be permitted only under the existing inventory provisions of the final order and the final order.
On December 10, 2024, EPA issued a proposed rule to withdraw the residue limits associated with all but 11 of the uses identified in the agency's 2020 Proposed Interim Decision for food and feed crop uses. based on available data, retaining only these 11 food uses is expected to result in a 70 percent reduction in the average weight of chlorpyrifos used annually in the United States compared to historical use.
