On April 20, 2023, USDA's Animal and Plant Health Inspection Service (APHIS) announced that a genetically modified apple meets the criteria for exemption. The genetically modified apple has anti-browning properties, which APHIS has previously reviewed and deregulated. APHIS assessed that the GM apple is unlikely to pose a higher risk of plant diseases and pests than non-regulated similar products, so it announced the deregulation of it, but it is still regulated by the Environmental Protection Agency and the Food and Drug Administration.
