On December 4, 2023, the South African Department of Agriculture, Land Reform and Rural Development issued through the Government Gazette the "Record-keeping and Declaration Measures for Pecans and their Products", a statutory measure applicable to domestic and imported pecans and pecan products, administered by the South African Pecan Producers Association (SAPPA). Main contents:
(1) All producers, processors, importers and exporters of pecans and pecan products shall, in accordance with the requirements of the State Forestry Administration, maintain records and submit returns relating to: the total amount of pecan and/or pecan products produced; The quantity of imported and/or exported pecans and/or pecan products; The number of pecans and/or pecan products processed by a processor. Records should be kept on a computer or in a journal and kept at the registered premises of the data person for a period of at least three years;
(2) Purchasers of pecan products, upon request, provide the price of the product/service or any similar information;
(3) The Ministry of Agriculture, Land Reform and Rural Development of the State or the assignee shall provide copies of all export certificates or provide the information required by SAPPA contained in such certificates within the prescribed period of time (three years);
(4) The aforesaid return shall be submitted to SAPPA in a form provided free of charge by SAPPA within fifteen days after the end of the month in which it is requested;
(5) This measure shall be implemented from the date of publication of the Government Gazette and shall be implemented for a period of 4 years.
