U.S. developed compliance guidance for small food producers following ban on PHOs

On April 26, 2024, according to the U.S. Federal Register, the U.S. Food and Drug Administration (FDA) issued Notice No. 2024-08955, which establishes compliance guidance for small food manufacturers following the ban on partially hydrogenated fats and oils. Key elements of the guidance include:


(1) Small food manufacturers should no longer use hydrogenated fats and oils as processed ingredients in foods such as canned tuna, peanut butter, margarine, shortening, bread, rolls, and other foods after FDA revokes the license to use partially hydrogenated oils (PHOs) in foods;


(2) Prohibit the use of partially hydrogenated herring oil as a food ingredient for direct use;


(3) Prohibit the use of partially hydrogenated fish oil as a food ingredient for indirect use (as dry food packaging).


The notice came into effect after it was published in the April 29, 2024 Federal Register.
