Case Study | Illegal Food advertising


Suzhou Industrial Park Yake Group Co., Ltd. published advertisement of
ordinary food on its WeChat public account, involving the content of “Reducing stress, enhancing physical strength, anti-fatigue, preventing hair loss, improving sleep quality, controlling the spread of cancer cells and anti-tumor”. The party cannot prove that the product has the abovementioned functions.

The action violated the provisions of Article 17 and paragraph 2 (2) of Article 28 of the Advertising Law.

According to the provisions of paragraph 1 of Article 55, and paragraph 2 of Article 58 (1) of the Advertising Law, the Suzhou Industrial Park Administration for Market Regulation imposed an administrative penalty, ordering the party to stop publishing illegal advertisements and imposing a fine of RMB 100,000 in January 2019.
