Hu bought several bottles of wine and found out the goods involved did not mark the warning words "Excessive drinking is harmful to health" on the label, and the labelled grade and year of wine did not meet requirements of relevant regulation.

The court considered that it belonged to a label flaw, did not affect food safety and did not cause misleading to consumers. Therefore, the court requested the company to refund the purchase payment and rejected the Hu’s claim for ten times compensation.
