On June 30, 2023, according to the Official Journal of the European Union, the European Commission adopted Regulation (EU) 2023/1329, amending Annex II of Regulation (EC) No. 1333/2008 as regards the use of polyglycerol polyricinoleate (E 476) and the Annex to Commission Regulation (EU) No 231/2012 as regards specifications for glycerol (E 422), polyglycerol esters of fatty acids (E 475) and polyglycerol polyricinoleate (E 476), effective on the 20th day after publication. The main contents are as follows:
1. The food additive glycerol (E422) legally placed on the market before 20 July 2023 does not comply with the maximum limits for arsenic, lead, mercury, cadmium or acrolein applicable from 20 June 2023, which can be determined according to (EC) 1333/2008 Add the provisions of Annex II and Annex III to food until January 20, 2024;
2. The food additive polyglycerol esters of fatty acids (E475) legally marketed before July 20, 2023 does not meet the requirements for arsenic, lead, mercury, cadmium, 3-chloropropanediol (3-MCPD) and 3- MCPD fatty acid esters (expressed as 3-MCPD), erucic acid or glycidyl fatty acid esters (expressed as glycidol), which may be added to food according to Annex II and III of Regulation (EC) No 1333/2008, up to January 20, 2024;
3. The food additive polyglycerol polyricinoleate (E476) that was legally marketed before July 20, 2023 does not meet the requirements for arsenic, lead, mercury, cadmium, and 3-chloropropanediol (3-MCPD) that will be applicable from July 20, 2023. ) and 3-MCPD fatty acid esters (expressed as 3-MCPD) or glycidyl esters (expressed as glycidol), which may be added to foods in accordance with Annex II and III of Regulation (EC) No 1333/2008, up to January 20, 2024.
