Q: What is the scope of using of the organic logo?
A: Article 32 of the Measures for Administration of Organic Product Certification stipulates that "China's organic product certification mark shall be used within the product category, scope and quantity specified in the certificate."
Q: Can a product claim to contain certain organic ingredients if it is not certified organic?
A: Claims are not recommended as they may be misleading.
According to the interpretation of the Measures for Administration of Organic Product Certification, in order to further regulate the market order of organic products and prevent the processing products that only contain some organic ingredients, without obtaining organic certificate for the product, and prevent marking "organic ingredient production", "organic" and other words on its products and misleading the public that the products are organic products. The new "Measures" canceled the original AQSIQ Order No. 67 on processed products containing organic ingredients while not certified organic products can be marked in their products "organic ingredients production" or ingredients for the word "organic" provisions, to help consumers identify and correctly understand the concept of organic products. Therefore, if the product has not passed the China Organic Certification, the label shall not be marked with the word "organic". Similarly, in order to avoid misleading consumers, it is not recommended to mark "organic" related content on other promotional materials such as web pages and posters.
Q: If the organic certificate is suspended or revoked for some reason, can the inventory products before revocation continue to be declared organic and sold until the expiration of the warranty period?
A: Products with organic logos shall not be sold continuously. Unpacked products may continue to be sold in ordinary packaging without organic logos.
If the organic certificate is suspended, according to Article 8.7.2 of the Organic Product Certification Implementation Rules, during the suspension period, the certification authority shall notify and supervise the certified organization to stop using the organic product certificate and logo, and the certified organization shall seal up the corresponding batch of products with the organic product logo.
If the organic certificate is revoked, according to Article 8.8 of the Organic Product Certification Implementation Rules, the certified organization shall return the canceled or revoked organic product certificate and unused logos to the certification authority, or the certified organization shall destroy the remaining logos and product packaging with organic logos under the supervision of the certification authority. If necessary, the certified organization shall recall the products with organic logos in corresponding batches.
Q: If for some reason a product on the organic certificate does not meet the requirements of organic products, can other products on the certificate continue to be sold as organic products?
A: It cannot be sold as an organic product.
Article 30 of the Measures for the Administration of Organic Product Certification stipulates that if the quality of certified products does not meet the relevant national requirements, the certificate will be revoked within 7 days. Since the certificate is revoked, other products listed on the certificate will also be affected. For example, the certificate includes whole milk powder and modulated milk powder. If the whole milk powder is found not to meet the requirements of organic products, the modulated milk powder will no longer be an organic product after the certificate is revoked.
